1.1 These terms and conditions (“Terms”) apply to all purchases by you (“You” or “Your”) from The baking company limited (each an “Outlet” and referred to throughout as “Us”, “We” or “Our”) from Thebakingcompany.co.nz (each a “Website”).
1.2 The Outlets may change these Terms at any time by publishing updated Terms on the Websites.
1.3 By purchasing a product from the Website (“Product”) You acknowledge that You have read and agree to these Terms.
1.4 Products on the Websites are available for purchase and delivery within New Zealand only. New Zealand law applies to all purchases made from the Websites.
2.1 When purchasing a Product or Products from the Website You confirm and acknowledge that:
(a) You have supplied Us with Your correct contact, delivery and payment details;
(b) that You have the authority to use the payment method You’ve provided Us and that there are sufficient funds to cover the cost of the Products You have ordered;
(c) You are purchasing the Products for private use and not for commercial resale;
(d) You can’t return any food Products once they’ve been opened, or any other Products once they’ve been used (in Our reasonable opinion);
(e) We will use your payment details to process the relevant payment and may supply these details to Our bank and/or credit card processor; and
(f) We can’t accept Products for return more than 30 days after You ordered them unless they’re faulty.
3.1 We do our best to make sure the images and details of the Products on the Website are correct but some small differences may exist with items such as clothing. To the extent permitted by law we’re not responsible for these differences.
3.2 While We take care to ensure sufficient stocks of Products, from time to time we may need to cancel an order made where Products are not available or the quality is not up to Our standards. In this situation we will refund You for any Product(s) ordered which cannot be provided.
3.3 We understand Our obligations under the Consumer Guarantees Act 1993. In the event that our Products are not of an acceptable quality or are faulty, We will replace the Products where possible and, where not possible, will refund You for your Products.
4.1 Prices quotes on the Website are inclusive of GST, given in New Zealand dollars and are correct at the time of order. Prices are subject to change from time to time and no adjustments will be made if the price of a Product changes between the time of order and receipt.
4.2 Full payment for Products ordered is due at the time Your order is submitted via one of the payment methods set out on the Website.
4.3 Courier charges may be applied in addition to Product prices and will be specified at the time of order.
5.1 We’ll do our best to send Your Products out within 2 business days of receiving Your order and full payment. Of course, our focus is food, so there may be delays during busy periods. If we haven’t sent out Your order for delivery within a week of receiving it, then You can elect to cancel Your order and receive a full refund.
5.2 If You don’t receive all or part of Your order (and it’s Our fault) or all or part of Your order is damaged we’ll work with you to arrange a replacement or a refund of the affected part. Please contact us at Thebakingco@outlook.co.nz if either of these unfortunate events occur.
5.3 We consider an order delivered when Our courier has confirmed that it has been.
6.1 Gift vouchers are valid for 12 months from the time of purchase and can be used to purchase food, beverages and products from either Outlet. Gift vouchers are not exchangeable or redeemable for cash.
6.2 We are not responsible for any lost or stolen vouchers. Vouchers are at Your risk once delivered.
